POHLMAN The following terms as used in this manual shall have the following definitions applied to them: OFFICER: Any person employed by the Red Wing Police Department in a full-time capacity and who possesses a full-time peace officers license issued by the State of Minnesota P.O.S.T. Board. 2. PART-TIME OFFICER: Any person employed by the Red Wing Police Department in a reserve officer capacity and who possesses a part-time peace officers license as issued by the State of Minnesota P.O.S.T. Board. 3. RESERVE OFFICER: Any person employed by the Red Wing Police Department in a reserve officer capacity who does not possess any type of peace officers license. 4. COMMUNITY SERVICE OFFICER: Any person employed by the Red Wing Police Department in a uniformed unlicensed capacity to assist with parking enforcement, beat walking, and other tasks as assigned by the Supervisor in charge of the Community Service Officers. 5. CIVILIAN EMPLOYEE: Any person employed by the Red Wing Police Department in any capacity not directly related to the enforcement of laws, patrol, or the investigation of violations of law. 6. COMMAND OFFICER: Any officer of the Red Wing Police Department above the rank of Sergeant. 7. SUPERVISOR: Any officer of the Red Wing Police Department holding the rank of Sergeant. Page 1 of 3 POLICY DEFINITIONS 8. RANKING OFFICER: Any officers holding a higher command or supervisory rank or position. If of the same rank, an officer of greater seniority. 9. SUPERVISORY OFFICER: Any officer of the Red Wing Police Department who, by reason of seniority, acquires a supervisory role over other officers due to the absence of regular command or supervisory personnel. 10. CHIEF OF POLICE: The highest-ranking P.O.S.T. licensed peace officer of the Red Wing Police Department. 11. SUBORDINATE: Any officer of lesser rank or position. If of the same rank, an officer of lesser seniority. 12. DEPARTMENT: The Red Wing Police Department. 13. EMPLOYER: The City of Red Wing. 14. LAWFUL ORDER: Any written or oral directive issued by a command officer, supervisor, or supervisory officer, to any subordinate or group of subordinates in the course of employment, which is not knowingly in violation of any law, ordinance, or department policy. 15. UNLAWFUL ORDER: Any written or oral directive issued by a command officer, supervisor, or supervisory officer, to any subordinate or group of subordinates in the course of employment which is known to be in violation of a law, ordinance, or department policy. 16. POLICY OR ORDERS: Departmental legislation consisting of detailed directives binding officers and employees of all ranks in terms of authority, responsibility, and conduct. 17. INSUBORDINATION: Shall include but not be limited to: A. The failure or refusal to obey a lawful order given by a ranking officer. B. The act of ridiculing a ranking officer or his/her orders, whether in his/her presence or not. C. The failure or refusal to answer questions during an internal departmental investigation of misconduct, or complaint against an officer, or refusal to cooperate in the investigation of the above. 18. DERELICTION OF DUTY: Shall include but not be limited to: A. The failure by commission or omission to actively or properly respond Page 2 of 3 POLICY DEFINITIONS to a request for service, ignoring a violation of Federal or State Statute, or local ordinance committed in the officer's presence, or absence from an assigned post, beat, or duty assignment, or from the City of Red Wing without permission of a supervisor or supervisory officer. B. Absence from duty through the use of sick leave when not actually sick, or not in conformance with City Policy and Union Contract sick leave provisions. C. Any failure to arrive for scheduled work shifts without authorized leave or failure to perform the duties required of a peace officer by the City of Red Wing and it's Police Department. 19. UNSATISFACTORY PERFORMANCE: Officers and employees of the Red Wing Police Department shall maintain sufficient competency to perform their duties and assume the responsibilities of their positions. Officers shall perform their duties in a manner which will maintain the highest standards of efficiency in carrying out the functions and objectives of the Red Wing Police Department. Demonstration of unsatisfactory performance shall be evidenced by, but not be limited to: A. Lack of knowledge or application of laws or ordinances. B. An unwillingness or inability to perform assigned tasks. C. A failure to conform to work standards established for and by officers of equal rank, grade, or position. D. A failure to take appropriate action on the occasion of a crime, disorder, call for service, or other condition requiring police intervention. (Also see DERELICTION OF DUTY above) E. Absence without leave from assigned post, beat, or duty assignment. (Also see DERELICTION OF DUTY above) F. Repeated poor employee evaluations. G. A written record of repeated infractions of policies or orders of the Red Wing Police Department, whether or not these infractions resulted in disciplinary actions being taken against the officer. 20. SHALL/WILL: For the purposes of this policy manual the words SHALL and WILL indicate that an action or policy is mandatory. 21. MAY: For the purposes of this policy manual, the word MAY indicates that an action or policy is discretionary. Page 3 of 3 POLICY DEFINITIONS
