POHLMAN PURPOSE: The Minnesota State Legislature mandates that Minnesota law enforcement agencies submit monthly reports to the Minnesota State Auditor on property that is seized subject to forfeiture. The report is due on the 20th of the month following the month reported on. The State Auditor provides an excel spreadsheet format (Appendix A) that is to be used. When no property is forfeited in a calendar year a "None Form" is required to be filed by the 31 st of January following the reporting year. The State Auditor allows filing the Forfeiture Incident Report by email to forfeitu res(a)osa. state. m n. us or by conventional mail. POLICY: It is the policy of the Red Wing Police Department to comply with the spirit and intent of Minnesota State Statute 609.5315 in a timely manner; meeting all suspense dates imposed by the Auditor. The Red Wing Police Department is responsible only for forfeited property seized by the Red Wing Police Department and will not report property seized by the Goodhue County Sheriff's Department. DEFINITIONS: A. FORFEITURE INCIDENT: The seizure of property subject to forfeiture. This includes property seized subject to forfeiture that results in an agreement between parties to return the property to owner. B. FORFEITABLE PROPERTY: Forfeited property that must be reported to the State Auditor. The following forfeited property is required to be reported Firearms and firearm accessories. 2. Cash money. Page 1 of 3 FORFEITURE INCIDENT REPORTING -POLICY 42 3. Precious metals and jewelry. 4. Vehicles - Excluding DWI forfeitures. 5. Bullet -Resistant vests. 6. Telephone Cloning Paraphernalia. C. NONE REPORT: Report required by the State Auditor when during the entire year no property is seized. Due the 31St of January following the end of reporting year. 2. PROCEDURES: A. Evidence Technician will: 1. Initiate a monthly Minnesota State Forfeiture Incident Reporting Form on the first working day of each month. 2. Utilize the Minnesota State Auditor Excel spreadsheet as depicted in Appendix A. 3. Post the working spreadsheet on the City of Red Wing server "L" Drive in the Police Reports folder. 4. When forfeiture property dispositions are received, enter the property on the working spreadsheet by completing columns 1-6 and 11. B. Investigative Sergeant will: 1. On the first working day of each reporting month, review the property entered on the forfeiture report. 2. Validate that the property qualifies as forfeiture property. 3. Complete columns 7-10 4. Submit completed report to the Chief of Police for review. 5. Upon approval, but not later then the 15th of each month, ensure that the forfeiture report is either sent or emailed to the Minnesota State Auditor. 6. Retain a file copy of all submitted forfeiture reports.
