POHLMAN PURPOSE: To establish a consistent policy for determination of when vehicle lock -outs will be done. To establish procedures to follow when the request does not meet the criteria when vehicle lock -outs will be performed. POLICY: It is the policy of the Red Wing Police Department that vehicle lock -outs will be performed only in emergency situations. 1. DEFINITIONS A. Vehicle Lock -out - a request by a vehicle owner or operator who has a legal right to have the vehicle, to open a vehicle to retrieve keys which have been locked inside. B. Emergency Situation any situation that the officer on scene believes is an emergency situation that dictates immediate entry into the vehicle. Examples include, but are not limited to, persons or animals locked inside a vehicle where immediate release is necessary. 2. PROCEDURES A. Officers of the Red Wing Police Department will not perform vehicle lock -outs unless there is an emergency situation present that requires the immediate opening of the vehicle. 1. In such cases the requesting party will be required to complete and sign a Lock -out Waiver Form which shall, in addition to advising them of a waiver of possible damage, indicate the nature of the emergency situation. B. In cases where an officer is approached to perform a vehicle lock -out that does not meet the criteria of an emergency situation, the officer will politely inform the requesting party that the Red Wing Police Department does not perform that service and will direct the requesting party to a suitable telephone directory to find a listed locksmith/lock-out service. 1. Under no circumstances will an officer make any recommendation as to any particular locksmith/lock-out service. The decision of which Page 1 of 2 VEHICLE LOCK -OUTS -POLICY 32 service to use shall be solely that of the requesting party. 2. Officers may assist the requesting party in locating a telephone and telephone directory to locate a locksmith/lock-out service, to include transportation to the nearest location that can provide telephone services to the requesting party.
