POHLMAN PURPOSE: The purpose of this policy is to provide guidelines for department personnel to follow in dealing with incidents that occur on school buses within the City of Red Wing. POLICY: It is the policy of this department that officers shall investigate all reports of crimes committed on school buses by using the same procedures as followed in any other criminal investigation. Officers shall submit a written report regarding the incident to the Chief of Police or their designate as required by this policy. When appropriate, that report shall be forwarded to the prosecuting attorney. The Red Wing Police Department shall provide information to the schools regarding the incident as required by law. Information shall be supplied to the school principal, where the student(s) are attending, by the Chief of Police or their designee. As with all complaints of this type, officers can use justifiable discretion in handling these matters. Officers shall take into account the seriousness of the offense, actions under consideration and/or taken by the school, and input from individuals affected by the criminal conduct. 1. DEFINITIONS A. SCHOOL BUS 1. A school bus shall be as defined in Minnesota Statute 169.01, Subd. 6. "...a motor vehicle used to transport pupils to and from a school as defined in section 120.101, or to school related activities, by the school or a school district..." B. REPORTABLE OFFENSE 2. A "Reportable Offense" shall be as defined in Minnesota Statute 169.4582, "...misbehavior causing an immediate and subsequent Page 1 of 2 CRIMINAL CONDUCT ON SCHOOL BUSES —POLICY 28 danger to self or surrounding persons or property..." This definition is pursuant to Minnesota Statute 127.29 covering school conduct. 2. GENERAL PROVISIONS A. This policy complies with the requirements of Minnesota Statute 169.4581, Law Enforcement Policy for Criminal Conduct on School Buses. B. The Red Wing Police Department supports cooperation with schools, parents, and transportation providers in fulfilling the requirements of Minnesota Statute 169.4581. In doing so, the Red Wing Police Department puts the safe passage of children to and from school as the main goal. C. The Red Wing Police Department recognizes that responding to reports of criminal conduct and activity on a school bus is a law enforcement function. D.
