PURPOSE: To establish guidelines for officers who are required to provide interviews
with defense attorneys, insurance adjusters or other non -law enforcement
related persons on their off-duty time. To establish a consistent and fair
method of compensation for those officers.
COMMENT: This rule is not intended to deprive victims of accidents or other incidents
from talking with the investigating officer(s). Attempts will be made to inform
the victim of the working hours of the officer(s) so that a meeting may be
arranged. In many cases the on duty Sergeant or office staff may be able to
answer any questions the victim might have.
1. ON -DUTY INTERVIEW REQUESTS
A. To insure that our function as a law enforcement agency is carried out, on -
duty officers will not be relieved of their assigned duties for the purposes of
interviews with non -law enforcement personnel, except under the following
circumstances:
1. If the work load allows an officer to be temporarily relieved of duties
for the purposes of an interview.
2. Authorization for an on -duty interview shall be obtained from the on
duty Supervisory Officer or senior officer if there is not a Supervisory
Officer on duty prior to the interview.
a. Officers who are involved in an on -duty interview shall not
accept any form of compensation from the interviewing agency
or company for any purpose.
2. OFF-DUTY INTERVIEWS
A. Interviews that occur on an off-duty basis shall be compensated for on an
overtime basis through provisions of the then existing Union Contract.
(minimum 2 hours)
1. Officers who are involved in off-duty interviews shall complete an

Overtime Authorization Form under the BILLED OVERTIME category,
providing a name and full mailing address of the company to be billed.
3. COURT APPEARANCES
A. Officers of this department shall not testify in any civil proceeding arising out
of their employment as a police officer with this department unless
subpoenaed to appear.
B. All court appearances occurring on an officers off-duty time resulting from
their employment with this department shall be compensated at time and one
half rate as per provisions of the then existing Union Contract.
1. Subpoena fees received by officers who will also receive
compensation under Union Contract provisions shall be surrendered
to the Red Wing Police Department.
4. REPORTS, RECORDS, PHOTOGRAPHS, DOCUMENTS
A. Copies of official records, reports, documents, photographs, CD's, video
tapes or other items associated with a case shall only be authorized for
release by the Chief of Police or their designates. Costs for copies of
documents shall be at the then existing rate. Costs for photographs shall be
the actual costs incurred to have copies made.
