HomeMy WebLinkAbout0010 - ATTENDANCE MANDATORY COURT TRAINING MEETINGSRed Wing Police Department Policy SUBJECT: POLICY NUMBER ATTENDANCE, MANDATORY COURT, TRAINING, 10 MEETINGS EFFECTIVE DATE January 18, 2008 REFERENCE(S): APPROVED BY: CHIEF ROGER D. POHLMAN PURPOSE: To establish guidelines regarding mandatory officer attendance at job related functions to include, but not be limited to, court appearances, department mandated training, and department meetings. To set forth mandatory minimum penalties for non-attendance or repeat non-attendance at employer determined mandatory functions. 1. COURT APPEARANCES A. Officers shall be required as a result of their employment with the Red Wing Police Department, to appear in court in connection with cases arising from that employment. B. The City or County Attorney's Office, whichever applies in a given case, shall provide notices to each officer as to court dates and times that the officer shall be required to attend. 1. Officers shall appear as notified unless they have been able to have the case postponed due to prior commitments. 2. In the event that an officer does not appear as required, the Sergeant or supervisory officer who is made aware of the failure to appear shall submit to the Captain a written report detailing the circumstances surrounding the officer's failure to appear. 3. The Captain shall review the failure to appear and submit his findings and recommendations to the Chief of Police. 4. Findings of failure to appear as notified without postponement shall be grounds for the disciplinary penalties set forth in this policy. 2. DRESS CODE FOR COURT APPEARANCES A. Officers that normally appear for duty in uniform shall appear for court in uniform unless attending court while on a limited duty status and not able to wear a gun belt and weapon. Page 1 of 4 ATTENDANCE, MANDATORY COURT, TRAINING, MEETINGS -POLICY 10 1. Officers shall wear the complete duty uniform, including gun belt and weapon. 2. Uniforms worn shall comply with provisions of Policy #4. B. Officers that normally appear for duty in plain clothes shall appear for court in the following attire: 1. Officers shall wear a shirt and tie, a suit with shirt and tie, or sports coat and dress slacks with shirt and tie. 3. DEPARTMENT MEETINGS A. Officers will be required to attend department meetings as a result of their employment with the Red Wing Police Department. 1. Officers shall attend department meetings as posted on the department bulletin/scheduling board unless they have been given specific permission by the Captain, or Chief of Police, if the Captain is not available, to be absent. 2. In the event that an officer does not attend as required, the Sergeant or supervisory officer who is made aware of the failure to attend shall submit to the Captain a written report detailing the circumstances surrounding the officer's failure to attend. 3. The Captain shall review the failure to attend and submit his findings and recommendations to the Chief of Police. 4. Findings of failure to attend as notified without permission to be absent shall be grounds for the disciplinary penalties set forth in this policy. 4. MANDATORY TRAINING A. On occasion the department shall require officers to attend mandatory training on given subjects. Officers attending on off-duty time shall be compensated under provisions of the then existing Union Contract. B. Notification of mandatory training shall be made by a posting on the department bulletin board indicating that the training is mandatory. 1. Officers shall attend mandatory training as posted on the department bulletin board unless they have been given specific permission by the Captain, or Chief of Police if the Captain is not available, to be absent. 2. In the event that an officer does not attend as required, the Sergeant or supervisory officer who is made aware of the failure to attend shall submit to the Captain a written report detailing the circumstances Page 2 of 4 ATTENDANCE, MANDATORY COURT, TRAINING, MEETINGS -POLICY 10 surrounding the officer's failure to attend. 3. The Captain shall review the failure to attend and submit his findings and recommendations to the Chief of Police. 4. Findings of failure to attend as notified without permission to be absent shall be grounds for the disciplinary penalties set forth in this policy. 5. OTHER MANDATORY ATTENDANCE A. On occasion officers will be mandated to attend other functions as a result of their employment with the Red Wing Police Department. 1. Officers shall attend mandatory functions as notified unless they have been given specific permission by the Captain, or the Chief of Police if the Captain is not available, to be absent. 2. In the event that an officer does not attend as required, the Sergeant or supervisory officer who is made aware of the failure to attend shall submit to the Captain a written report detailing the circumstances surrounding the officer's failure to attend. 3. The Captain shall review the failure to attend and submit his findings and recommendations to the Chief of Police. 4. Findings of failure to attend as notified without permission to be absent shall be grounds for the disciplinary penalties set forth in this policy. 6. NOTIFICATIONS A. Posting of mandatory functions, training, or meetings shall be made on the department bulletin/scheduling board. The posting shall be so worded to indicate that attendance is mandatory. Officers shall be required to initial the posting to verify that he/she has read the posting. B. Court appearance notification shall be done through normal court procedures or by subpoena. 7. REPORTING A. Any Sergeant or supervisory officer who becomes aware of a situation of non-attendance and who fails to report that non-attendance as required by this policy shall be subject to the disciplinary penalties set forth in this policy. 8. MINIMUM DISCIPLINARY PENALTIES A. A mandatory minimum disciplinary penalty for non-attendance at any Page 3 of 4 ATTENDANCE, MANDATORY COURT, TRAINING, MEETINGS -POLICY 10 mandatory function, training, meeting, or court appearance, or a failure to report a known non-attendance may be grounds for disciplinary action.
